TERMS OF SERVICE
1. Description of Service
Spot A Kitch provides temporary, mobile kitchen units for residential use during renovations, repairs, insurance claims, or similar circumstances. Units are delivered, installed, and removed by Company personnel. The Unit is intended for temporary residential use only.
2. Rental Term & Fees
The base rental fee includes delivery, setup, and the first 30 days of use. Rental fees must be paid prior to delivery unless otherwise agreed in writing. Extensions beyond the initial rental period may incur additional charges. Optional services and add ons include but are not limited to water tank pump-out, are billed separately.
3. Utilities & Installation Conditions
Water Supply may be supplied from an accessible interior or exterior source, including kitchen lines, bathroom lines, or hose bibs. Client acknowledges that older or rarely used shut-off valves may leak or fail when operated.
Company is not responsible for pre existing plumbing issues or incidental leaks caused by accessing existing connections. Drainage in many cases, it is not feasible or permissible to connect the Unit’s drain directly to the home’s plumbing without modification.
Wastewater may be collected in an external holding tank. Pump-out or disposal services may be required and billed separately based on usage. Power Electrical requirements must be met by the Client’s property. Company is not responsible for inadequate electrical capacity or outages.
4. Inherent Risks & Assumption of Risk
Client acknowledges that use of a temporary mobile kitchen involves inherent risks, including but not limited to: Trip hazards from hoses, cords, or utility lines Temporary routing of lines through doors, windows, or thresholds, Reduced sealing or security effectiveness due to temporary access points.
Client voluntarily assumes all risks associated with the presence and use of the Unit and agrees that Spot A Kitch shall not be held liable for injury, illness, loss, or damage to persons, pets, or property arising from normal use of the Unit.
5. Liability Waiver & Indemnification
To the fullest extent permitted by law: Client releases and holds harmless Spot A Kitch, its owners, employees, and contractors from all claims arising from use of the Unit.
Client agrees to indemnify and defend Spot A Kitch against any claims, damages, or expenses resulting from Client’s use, misuse, or alteration of the Unit.
6. Client Responsibilities
Client agrees to: Use the Unit in a reasonable and responsible manner Keep the Unit accessible and unobstructed.
Prevent unauthorized use. Notify Company promptly of any issues or damage. Client is responsible for damage caused by misuse, negligence, or unauthorized modifications.
7. Damage & Wear
Normal wear is expected. Client will be responsible for: Damage beyond normal wear: Missing components, Damage caused by pets, guests, or third parties. Repair or replacement costs may be billed accordingly.
8. Access & Placement
Client must provide clear and safe access for delivery, setup, servicing, and removal. Company is not responsible for delays caused by blocked access, unsafe conditions, or third-party interference.
9. Cancellation & Rescheduling
Cancellations must be made within the time frame communicated at booking. Late cancellations or failed deliveries due to site inaccessibility may result in fees.
10. Compliance With Laws
Client is responsible for compliance with any local ordinances, HOA rules, or permits related to placement of the Unit on their property.
11. Limitation of Liability
In no event shall Spot A Kitch be liable for indirect, incidental, or consequential damages, including loss of use, loss of enjoyment, or alternative living expenses.
12. Governing Law
This Agreement shall be governed by the laws of the state in which the service is provided.
13. Entire Agreement
This document constitutes the entire agreement between the parties and supersedes all prior communications. No modification is valid unless made in writing.
Acknowledgment By reserving or accepting delivery of a Spot A Kitch unit, Client acknowledges that they have read, understood, and agreed to these Terms of Service.
